These terms and conditions, which are subject to change periodically apply to all users of the booking platform. By accessing our booking platform, by carrying out research, by carrying out a reservation, you declare understand the scope and accept our terms of use.

1. Our service

Through the website from which you accessed our booking platform, and its licensees Elloha.com (tourism providers or affiliated sites diffusing booking platform) provide an online booking platform for the reservation of products and services for tourism and recreation. These services and products are offered by the operators of these own services or their agents. In no event will Elloha.com regarded as the producer or operator of such services or goods for tourism and recreation. By making a reservation through Elloha.com, you engage in a direct contractual relationship with the institution concerned with your reservation. Elloha.com acts only as an intermediary between you and the institution: we send him the details of your booking and send you a confirmation email for and on behalf

On. the provision of our services, the information we communicate is based on the information recorded by establishments under their own responsibility. So institutions are given access to our platform (extranet) through which they hold full responsibility to update all their rates, availability and other information displayed on the booking engine. Although we strive to provide a quality service, we can not verify or guarantee the accuracy, precision or completeness of the information, and we can not be held responsible for any errors (obvious error or typographical error ), any interruption in service (due to a technical failure, whether temporary and / or partial outage, repair, updating, improvement or maintenance our website or otherwise), any inaccurate, misleading or false, or any lack of information. 2. Confidentiality of information and cookies

Elloha.com respects your personal data transmitted to the operator of the service that you book at the time of booking confirmation.

3. Free

Our service is free. We will not charge our service and we will add no additional cost (booking) and costs.

4.Carte banking and bank transfer

The bookable via Elloha.com institutions are paid directly (in whole or in part, according to the payment terms of the establishment set out below) during the booking process with secure online payment means. Payment is made securely from your credit / debit card to the hotel, through a third party payment processor.

For some nonrefundable rates and special offers, please note that the property reserves the right to require payment in advance by credit card and therefore pre-authorize your credit card or levy a certain amount (sometimes without refund) on the same card at the booking. Before making your reservation, please carefully read the description of services and products offered to take notice of such conditions.

5. Cancellation

By making a reservation in a facility, you acknowledge having read and accepted the conditions of cancellation and no-show of the facility, and any additional requirements of that institution can apply to your reservation or during your stay, including for services rendered and / or products offered by the establishment. The general cancellation and no-show specific to each institution are set out below; they also recalled during the reservation process and in the booking confirmation email. Please note that certain rates or special deals do not allow to cancel or modify the reservation. You are invited to read the conditions of each property prior to booking. Reservations require a deposit or prepayment (full or partial) can be canceled (without warning or prior notice of default) if the amount or amounts (or balances) requested are not received in full at the agreed date of payment, as the payment terms of the establishment and the corresponding reservation. You will be considered responsible for any delay in payment, all bank details, credit card or debit incorrect, any credit / debit card or invalid all insufficient funds and not be entitled to any refund of prepayment (non-refundable) unless otherwise specified in the conditions of (pre) payment and cancellation of the establishment.

If you want to change or cancel your reservation, please refer to the e-mail confirmation and follow the instructions given therein. Please note that any cancellation fee may be charged, according to the cancellation policy, (pre) payment and non-presentation of institutions and it is possible that the amounts (pre) paid will not be refunded. We recommend that you read the cancellation policy, (pre) payment and no-show prior to making your reservation and to make any payment to come within the deadlines agreed for the said reservation.

6. Future correspondence

By making a reservation, you agree to receive (i) an e-mail that we will send you before your arrival date in the facility, which will contain information on your destination and relevant offers for your stay (including offers from our partners, if you have agreed to receive them), and (ii) an email which we may send you after your stay in establishment, and invite you to complete our questionnaire scores.

7. Disclaimer

In accordance with the limitations set out in these terms and conditions of use and permitted by law, we can not be held responsible if you have suffered, paid or incurred direct damages can be attributed to a failure of our obligations as part of our services. These damages may amount up to the total cumulative cost of your booking, as indicated in the confirmation e-mail, whether it is an isolated event or series of events linked. Nevertheless, and to the extent provided by law, neither we nor our directors, officers, employees, representatives, subsidiaries, affiliates, distributors, partners (distribution), sub-licensees, agents or others involved in creating, sponsorship, promotion or provision of the platform and its contents shall be liable for (i) any loss or punitive damages, special, indirect or consequential loss of production, loss of profit, loss of revenue , loss of business opportunity, loss or damage to brand or reputation, or loss of the right to compensation; (ii) any inaccuracy relating to the (descriptive) information of the institution (including its rates, its availability and ranking) provided on our booking platform; (iii) any services or products offered by the establishment or other partners; (iv) any damages, losses and costs (punitive, special, indirect or consequential) suffered, incurred or paid by you, attributable to, arising out of or relating to the use of our booking platform, the impossibility of its use or slowing its operation; or (v) any injury, death, property damage or other damages, losses or costs (direct, indirect, special, consequential or punitive) suffered, incurred or paid by you, whether due to acts (legal) , errors, failures, negligence, (severe), willful misconduct, omissions, breach of contract, denaturation of the facts, to rightly or strict liability fully or partially attributable to the institution (including its employees, its management, its officers, agents, representatives or affiliates) whose products and services are (directly or indirectly) offered or promoted on or through our reservation platform, including any cancellation (even partial), overbooking, strike, force majeure or other event beyond our control.

You acknowledge and agree that business where you make your booking is at all times responsible for the collection, retention, payment and payment of applicable taxes due on the total amount of the fare to the relevant financial authorities. 8. Intellectual property rights

Elloha.com remains the sole owner of all right, title and interest (related to all intellectual property rights) of the booking platform (presentation and infrastructure including) where the service is available. Therefore, you may not copy, create links (hyper or deep) to our content, publish, promote, market, integrate or otherwise use our content and our brand without our express written permission. To the extent that you use (some or all of) our détiendriez content or intellectual property rights to our booking platform, our content, you must assign, and transfer these rights to Elloha.com. Any illegal or above action will constitute a material breach of our intellectual property rights (copyright and law on the basis of data included).

9. Various

According to the law, these general conditions of use and provision of our services are subject to and governed by French law. Any dispute arising under these terms and conditions and our services shall exclusively be brought to the attention of the competent authorities in Paris, France.

If any provision of these terms and conditions is or becomes invalid, unenforceable or non-binding, you remain bound by all other provisions established in these conditions. If this is the case, the invalid provisions will be applied within the possible limits of the law and you agree to comply with the provisions that would have the same effect as the invalid terms, non-binding or non-binding of these general conditions use.

More security in your payments

A new payment regulation mandatory for all e-commerce sites (DSP2) is in place to secure your online payments.

Booking conditions

Article 1. Objet : Ce contrat est réservé à l’usage exclusif des locations de vacances et seule la loi française est applicable au contrat.

Article 2. Dispositions Générales : Aucune modification (rature, surcharge, ...) ne sera acceptée dans la rédaction du contrat sans l’accord des deux parties.
Le propriétaire s’engage à ne divulguer à aucun tiers les informations de quelque nature que ce soit, sur quelque support que ce soit, que le locataire aura été amené à lui donner à l’occasion de l’exécution du présent contrat.
Ces dernières dispositions ne sont toutefois pas applicables s’agissant des demandes de renseignements qui seraient formulées par les administrations et/ou les Tribunaux.

Article 3. Conclusion du contrat et paiement : Des arrhes seront versées dès réception du contrat, d'un montant représentant 30% du prix de la location. Des arrhes sont considérées comme dédit à valoir sur le prix de la location. Le solde sera versé au plus tard à votre arrivée. La réservation devient effective dès lors que le locataire aura versé le montant représentant 30% du prix de la location, soit par CB lors d'une réservation sur Internet soit par chèque lors d'une réservation manuelle (à laquelle s'ajouteront des frais de dossiers).
Les charges non incluses dans le loyer (en moyenne et haute saison) doivent être acquittées en fin de séjour.

Article 4. Dépôt de garantie : Le locataire verse à son arrivée un dépôt de garantie. Il sera restitué dans un délai maximum d’1 mois à compter du départ du locataire, déduction faite, par le propriétaire, des montants à la charge du locataire aux fins de remise en état des lieux.
Le montant de ces retenues devra être dûment justifié par le propriétaire sur la base de l’état des lieux contradictoire de sortie, constat d’huissier, devis, factures… Si le dépôt de garantie est insuffisant, le locataire s’engage à compléter la somme sur la base des justificatifs fournis par le propriétaire. Ce présent cautionnement ne pourra en aucun cas être affecté ou considéré comme participation au paiement du loyer.

Article 5. Durée : Le locataire doit quitter les lieux à l’heure prévue par le contrat ou à une heure convenant au propriétaire, après état des lieux.
Le locataire ne peut en aucune circonstance se prévaloir d’un quelconque droit au maintien dans les lieux à l’expiration de la période de location initialement prévue par le contrat, sauf accord du propriétaire.

Article 6. Utilisation des lieux : Le propriétaire fournira le logement conforme à la description qu’il en a faite et le maintiendra en état de servir. Le locataire jouira de la location d’une manière paisible et en fera bon usage, conformément à la destination des lieux. Les locaux loués sont à usage d’habitation provisoire ou de vacances, excluant toute activité professionnelle de quelque nature que ce soit (maximum 3 mois).
A son départ, le locataire s’engage à rendre la location aussi propre qu’il l’aura trouvée à son arrivée. Toutes réparations quelle qu’en soit l’importance, rendues nécessaires par la négligence du locataire en cours de location, seront à sa charge.
La location ne peut en aucun cas bénéficier à des tiers, sauf accord préalable du propriétaire. La sous-location est interdite au preneur, même
à titre gratuit, sous peine de résiliation de contrat ; le montant intégral du loyer restant acquis ou dû au propriétaire.
L’installation de tentes ou le stationnement de caravanes sur le terrain de la propriété louée est interdit, sauf accord préalable du propriétaire.
Le nombre de locataires ne peut être supérieur à la capacité d’accueil maximum indiquée sur le catalogue ou l’état descriptif. A titre exceptionnel
et sous réserve de l’accord du propriétaire, il pourra être dérogé à cette règle. Dans ce cas, le propriétaire sera en droit de percevoir une majoration de prix qui devra être préalablement communiquée au locataire et consignée sur le contrat de location.

Article 7. Accueil d’animaux : Si le propriétaire accepte l’accueil d’animaux domestiques, le locataire doit lui préciser les animaux qui l’accompagnent. Le recto du contrat précise les conditions tarifaires d’accueil de ces animaux. Un règlement intérieur défini par le propriétaire peut préciser les modalités d’accueil de ces animaux.

Article 8. Etat des lieux et inventaire : L’état des lieux contradictoire et l’inventaire du mobilier et divers équipements sont faits en début et en fin de séjour par le propriétaire ou son mandataire dûment habilité et muni d’un pouvoir écrit et le locataire. En cas d’impossibilité de procéder à l’inventaire lors de l’arrivée, le locataire disposera de 72heures pour vérifier l’inventaire affiché et signaler au propriétaire les anomalies constatées. Passé ce délai, les biens loués seront considérés comme exempts de dommages à l’entrée du locataire. Un état des lieux contradictoire de sortie doit obligatoirement être établi. Le locataire accepte que cet état des lieux puisse être effectué soit avec le propriétaire ou son mandataire. Si le propriétaire ou son mandataire constate des dégradations, il devra en informer le locataire sous huitaine.

Article 9. Conditions de résiliation :
Toute résiliation du présent contrat doit être adressée par courrier recommandé avec accusé de réception, la date de réception faisant foi.
a) Résiliation à l’initiative du locataire
En cas d’annulation par le locataire avant l’arrivée dans les lieux, l’acompte reste acquis au propriétaire, et le solde du montant du séjour est intégralement dû par le locataire.
Si le locataire ne se manifeste pas dans les 24 heures qui suivent la date d’arrivée indiquée sur le contrat, le présent contrat est annulé et le propriétaire peut disposer de sa location. L’acompte reste également acquis au propriétaire qui peut demander le paiement du solde de la location.
b) Résiliation à l’initiative du propriétaire
En cas d’annulation par le propriétaire, celui-ci reverse au locataire l’intégralité des sommes versées. Le locataire peut demander des dommages et intérêts ou des indemnités pour le préjudice moral et le préjudice financier subi.
c) En cas de résiliation en cours de contrat
Lorsque la résiliation du contrat par le propriétaire intervient pendant la durée de la location, elle doit être dûment justifiée (défaut de paiement du loyer, chèque sans provision émis par le locataire, détérioration avérée des lieux loués, plaintes du voisinage, …). Cette résiliation, qui intervient par courrier recommandé avec accusé de réception, entraîne le départ du locataire dans les deux jours de la date de réception du courrier lui notifiant cette décision. Dans ce cas, quelle que soit la cause de la résiliation, l’intégralité du montant des loyers demeure acquise au propriétaire. Le propriétaire se réserve le droit de conserver le montant du dépôt de garantie dans les conditions précisées au paragraphe «dépôt de garantie ».

Article 10. Interruption du séjour : En cas d’interruption anticipée du séjour par le locataire, et si la responsabilité du propriétaire n’est pas mise en cause, il ne sera procédé à aucun remboursement, hormis le dépôt de garantie.

Article 11. Assurances : Le locataire est tenu d’assurer le local loué.
Il doit vérifier si son contrat d’habitation principale prévoit l’extension villégiature (location de vacances). Dans l’hypothèse contraire, il doit intervenir auprès de sa compagnie d’assurances et lui réclamer l’extension de la garantie ou bien souscrire un contrat particulier, au titre de clause “villégiature”. Une attestation d’assurances lui sera réclamée à l’entrée dans les locaux.

Article 12. Litiges - Médiation de la consommation : En cas de litige entre le Client et l’entreprise, ceux-ci s’efforceront de le résoudre à l’amiable (le Client adressera une réclamation écrite auprès du Vendeur). A défaut d’accord amiable ou en l’absence de réponse du professionnel dans un délai raisonnable d’un mois, le Client consommateur au sens de l’article L.133-4 du code de la consommation a la possibilité de saisir gratuitement, si un désaccord subsiste, le médiateur compétent inscrit sur la liste des médiateurs établie par la Commission d’évaluation et de contrôle de la médiation de la consommation en application de l’article L.615-1 du code de la consommation, à savoir : La Société Médiation Professionnelle - www.mediateur-consommation-smp.fr - 24 rue Albert de Mun - 33000 Bordeaux.
